DEPARTMENT MEMORANDUM CIRCULAR NO. 10-74

Quoted hereunder is the 1st Indorsement of the Secretary of Finance dated March 15, 1974:

"Respectfully returned to the Honorable Secretary of Agrarian Reform, Quezon City.

Representations are made in the basic letter dated February 25, 1974 of that Office that the lawyers employed in that Department who have been designated as official notaries public and commissioned by the court as such, exercise authority limited only to matters concerning the Department of Agrarian Reform.

In view thereof, and in line with the provisions of Section 12, 8th paragraph, at the Local Tax Code that professionals exclusively employed in the government shall be exempt from the payment of an occupation tax, this Department holds the view that the lawyers concerned are not liable to pay the professional tax. In all documents authenticated by them, they may just stamp the phrase "Exempt from occupation tax" in lieu of PTR numbers.
