DAR MEMORANDUM CIRCULAR NO. 06-98

TITLE          :     Amendment to Memorandum Circular
                           No. 9, Series of 1997 Entitled "Recalling
                           the Authority to Approve/Disapprove /Act
                           on Protest Cases of Regional Directors
                           (RDs) in Certain Provinces in Regions III
                           and IV Granted Under Administrative
                           Order Nos. 9, 10 and 12, Series of 1994
                           and Administrative Order No. 5, Series
                           of 1992".

RATIONALE/PREFATORY STATEMENT

In view of the issuance of DAR A.O. 7, S. 1997 and the streamlining of procedures for protests, upon the request of the Assistance Secretary for Policy, Planning and Legal Affairs and the Head of the CLUPPI 2 Secretariat, and with the concurrence of the Regional Director of DAR Region III, this amendment of Memorandum Circular No. 9, S. 1997 is hereby issued for the guidance of the DAR and the public in general.   ETHIDa

SECTION 1.            Item IV of Memorandum Circular No. 9, S. 1997 (Coverage) is hereby amended to read as follows:

These rules shall apply to all landholdings located in the following critical provinces: Cavite, Batangas, Laguna, Quezon I, Quezon II and Rizal, which are being applied or intended to be applied for conversion or exemption/exclusion, or other protests from coverage, irrespective or the area/hectarage involved.

SECTION 2.            All applications pending with CLUPPI 2 as of the effectivity of this Memorandum Circular shall continue to be processed by CLUPPI 2. All future applications shall be processed by the Regional Office, Region III.

SECTION 3.            This Memorandum Circular amends Memorandum Circular No. 9, S. 1997.   SDEHCc

This Circular takes effect immediately.
